These Terms of Service ("Terms") govern your use of the Clean My Biz Pty Ltd ("we", "us", "our") website at cleanmybiz.com.au and any commercial cleaning services we provide. By using our website or engaging our services, you agree to these Terms.
1. Services we provide
Clean My Biz provides commercial and industrial cleaning services in Melbourne metro, including office cleaning, industrial cleaning, warehouse cleaning, window cleaning, carpet and floor care, builders clean, graffiti removal, sanitisation, and specialised services. The specific scope of any engagement is defined in a written proposal we provide after a site visit.
2. Engaging our services
Our services begin with a free site visit and scope review. Following the site visit, we provide an itemised written proposal. Services commence only after you accept the proposal in writing (email confirmation is sufficient) and we have agreed a start date.
A 30-day Test phase applies to new ongoing contracts. During Test, we refine scope, frequency and crew assignment with you. After Test, the engagement continues on the agreed ongoing terms.
3. Pricing and payment
Pricing is set out in your proposal. All prices exclude GST unless otherwise stated. Pricing reflects the scope, frequency, and surface conditions agreed at engagement. Material changes to scope may result in pricing adjustment after written agreement.
Invoices are issued on the schedule agreed in your proposal (typically monthly in arrears for ongoing contracts, on completion for one-off services). Payment terms are net 14 days from invoice date unless otherwise agreed.
Late payment may incur interest at the rate prescribed under the Penalty Interest Rates Act 1983 (Vic) on overdue amounts.
4. Cancellation and exit
For ongoing contracts, either party may end the engagement with reasonable written notice (typically 30 days). We will continue service through the notice period and hand over documentation of your scope, inventory, and any custom protocols to your incoming provider.
For one-off services, cancellation within 24 hours of scheduled start may incur a call-out fee covering crew mobilisation costs.
If our service falls below the standard described in your proposal, contact us at info@cleanmybiz.com.au or 0433 173 504. We will re-clean within one business day at no charge. Our contracts include a fair exit path if standards are not met.
5. Your responsibilities
To enable us to deliver service, you agree to:
- Provide reasonable access to the premises during the agreed service window.
- Notify us in advance of any site-specific access requirements (security passes, inductions, after-hours arrangements).
- Notify us in advance of any change to the site that materially affects scope (renovation works, headcount changes, hours of operation).
- Maintain a safe workplace consistent with applicable WHS legislation.
- Notify us as soon as reasonably practicable of any service quality concern.
6. Insurance and liability
We hold current Public Liability and Product Liability insurance. Certificate of currency is available on request.
To the maximum extent permitted by law, our total liability arising out of or in connection with our services is limited to the fees paid by you for the specific service or month in which the relevant claim arose.
Nothing in these Terms limits or excludes any consumer guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be limited or excluded.
We are not liable for any indirect, consequential, or economic loss, including loss of profit, business interruption, or loss of data, arising in connection with our services.
7. Workplace health and safety
We operate in alignment with WorkSafe Victoria standards. For scope involving work at heights, confined spaces, hazardous chemicals, or specialist equipment, we issue Safe Work Method Statements (SWMS) for review with your facility lead before work commences.
You agree to advise us of any site-specific hazards or restrictions before service commences and to notify us promptly of any incident or near-miss occurring during service delivery.
8. Confidentiality
We treat any information about your business or premises learned in the course of providing service as confidential. Our crews are police-checked and bound by confidentiality obligations as a condition of their engagement.
9. Privacy
Our handling of personal information is governed by our Privacy Policy. By engaging our services, you agree to the collection and use of personal information as described in that policy.
10. Intellectual property
The content on the cleanmybiz.com.au website (including text, images, logos, and the T3 Methodology branding) is owned by Clean My Biz Pty Ltd. You may not reproduce, distribute, or commercially use this content without our written permission, except as permitted under the Copyright Act 1968 (Cth).
11. Governing law
These Terms are governed by the laws of Victoria, Australia. The parties submit to the exclusive jurisdiction of the courts of Victoria for any dispute arising under these Terms.
12. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Material changes will be communicated to active clients in writing.
